changing legal landscape

so the pentagon is going to transfer guantanamo detainees to prisons in saudi arabia, afghanistan and yemen. as the article behind the above link notes, this decisions comes in response to the supreme court's rasul decision which required that the pentagon allow gitmo detainees to challenge their detention in u.s. courts:
"It's fair to say that the calculus now is different than it was before, because the legal landscape has changed and those are factors that might be considered," a senior Defense Department official said.
there are currently an estimated 540 detainees in gitmo and the pentagon is talking about reducing the detainee population there to under 200. that means more than half of the current detainees may be transferred simply because the pentagon does not believe it can justify their detention to an independent entity.

the right to demand such independent review of government detention is probably the most basic human right guaranteed by the u.s. constitution. and yet our government would rather transfer detainees to such shining lights of liberty as saudi arabia rather than comply with an order of the supreme court. freedom is truly on the march! it's marching farther away every day.
