strategy

i hinted at this below, and this is repeating a point i made in echidne's comments but:

the ledbetter v. goodyear tire decision (pdf) came out of a sex discrimination/equal pay lawsuit. but the ruling was about how to apply the 180 day/300 day statute of limitations that is the same limitation that applies in most discrimination lawsuits, not just sex discrimination and equal pay act cases. in other words the ledbetter decision will be used to throw out race, national origin, religion, age, and disability discrmination suits, as well as sex discrimination cases like the one brought by lilly ledbetter.

when congress next tries to overturn the decision, they should focus on the ruling's effects on religious discrimination. for example, republicans opposed to the bill should be asked why they want to allow employers to pay evangelical christians half as much as atheists, solely on the basis of the christians' belief in jesus.

a lot of republicans in congress don't give a shit about sex discrimination, there's no point in framing the debate that way if you're trying to woo republican crossovers. a lot of them probably don't give a shit about evangelicals either, but they at least pretend to give a shit about them and their evangelical supporters certainly give a shit about evangelicals. also it's an election year. the republicans certainly give a shit about that.
