I could also see an argument that if the moops win in the Burwell case (i.e. the Justices strike down the subsidies for people who get coverage through the federal run Obamacare exchanges), that the administrations hand could be strengthened. Instead of giving in to the demands of people who oppose the ACA Obama could just sit back and watch the hammer come down on the state's that refuse to set up their own exchange. All those people losing their subsidies (and thus their ability to buy insurance just because their governor has been acting like a dick about the health care law) is gong to generate political pressure for the state to set up an exchange.
