in the days of yore

i always find this kind of argument to be really annoying. basically, jean smith is arguing that because all sorts of court packing (and unpacking) shenanigans went on for the first hundred years of this country's history, messing with the makeup of the supreme court for purely political reasons okee-dokey.

the legal history does make an interesting story, but that's no substitute for an actual argument.
