here's your hypo: a guy takes the massachusetts bar exam. there's a domestic relations question which asks about the respective rights of two spouses in a divorce. the guy doesn't answer the question because the spouses in question are named "mary" and "jane." gay marriage is legal in massachusetts. the guy fails the bar exam by a narrow margin. he sues for $9.75 million claiming the test discriminates against people who don't believe in gay marriage.
it looks like i missed out on my big chance for the big bucks, three chances actually. i've taken three bar exams in my life. i passed each one, but who knows what would have happened if i left those death penalty questions blank. i don't believe in the death penalty, but it never occurred to me that each time my eyeballs had to scan over those questions i was suffering a grievous injury--almost ten million dollars worth of injury.
hell, forget the death penalty. for ten million dollars, i don't believe in the rules of evidence either. that knocks out about 1/6 of the multistate portion of the test. i'm sure i would have failed if i skipped that many questions. after my last bar, i swore i'd never do another one. but if this guy wins, i'm definitely gonna sign up for the massachusetts bar.
