If the 2012 election "did not litigate" the issue of ObamaCare because Romney was the GOP nominee, then Jim DeMint and the Heritage Foundation can't litigate ObamaCare now.
Just as Romney has RomneyCare in his history, the Heritage Foundation has the fact that it invented the framework used by both RomneyCare and ObamaCare. As for DeMint, he supported Romney during the GOP primaries in both 2008 and 2012. In 2007, DeMint explained that RomneyCare was the reason he was supporting Romney for President. In fact, he advocated RomneyCare as "something we should do for the whole country."
Maybe Romney was an imperfect messenger for the irrational ObamaCare hatred that is currently in vogue on the right. But both DeMint and the think tank he leads are equally bad messengers for that same message now.
